Adrian Fernandez 62 of Racine who was charged on May 31st with felony 2nd Degree Sexual Assault of Child, and felony Child Enticement-Sexual Contact, and was being held on $25,000 now faces additional charges of Stalking. He has a preliminary hearing scheduled for June 15th.
According to a new criminal complaint issued -During the course of the investigation, Investigators with the Racine Police learned the assault took place on April 30, 2016, but the assailant was in the business multiple times that day and again on May 1, 2016. Investigators learned the victim observed two Hispanic males inside the business on April 30, 2016. The victim went to clean the men’s room and one of the males, later identified as Adrian Fernandez followed him inside the bathroom. The victim was in and out of the bathroom cleaning and at one point Fernandez confronted him in the bathroom, commenting on the victim’s body and asking to touch him. The victim told Fernandez he could not touch his body. While the victim was bent over cleaning under a sink in the bathroom, Fernandez walked up behind him and used his right hand to rub the victims buttocks
The victim immediately reported the incident to his manager, while Fernandez was sitting inside the business, and was told to alert someone if Fernandez came back to the business again. Fernandez remained at the business for several minutes before leaving. Fernandez returned to the business the following day, May 1, 2016, while the victim was working. The victim observed Fernandez pass him and walk to the men’s room. As Fernandez passed him, he whispered, “come here,” before walking into the men’s room. While the victim was cleaning in the business, he observed Fernandez crack the bathroom door and make a “psst” noise in his direction. Fernandez eventually went to the register to place an order, but made sexual motions with his tongue towards the victim.
According to the criminal complaint the victim reported the incident to the same manager he previously notified, stating Fernandez was sitting in the business. The manager told the victim to tell another manager, but to advise her if Fernandez did anything else. Fernandez eventually left the booth where he was sitting, passing the victim and whispering, “You want more?”
On May 2, 2016 the victims mother transported him to the Racine Police Department to report the assault. Fernandez was interviewed on May 27, 2016 by a Spanish speaking investigator. During the course of the interview, Fernandez admitted to being present at the business multiple times on April 30, 2016, including one time during which he had contact with a male employee in the bathroom. Fernandez admitted returning on May 1, 2016 and summoning the employee to the bathroom.
