John Clay, 45 of Racine has been charged with First Degree Intentional Homicide for the 1994 homicide of Andre McKinstry. He is being held on $75,000 bond after making his initial appearance in Racine Circuit court on Friday November 6,2015. His Preliminary hearing is scheduled for 11-12-2015
According to the criminal complaint, on August 14, 1994 Racine Police responded to Steve and B’s Tavern located at 1224 16th Street for a shooting. As police arrived on scene numerous patrons were fleeing the scene, officers discovered Andre McKinstry inside the bar who had been shot five times. He had suffered wounds to his left cheek, upper left chest, left and right side of his neck, and also a gunshot wound to his left knee. He was transported to the hospital where he died from his wounds.
Witnesses interview by police stated that the victim entered the bar and began a conversation with the defendant. Multiple witnesses stated that the defendant pulled out a black handgun and fired it at the victim. According to the criminal complaint the witnesses were able to positively identify the defendant as the person who had shot Andre McKinstry.
The complaint states that while police were investigating the homicide it was determined that there was animosity between the defendant and victim over the victim having contact with the defendants girlfriend.
