Man charged with drunk driving asks Deputies “Can’t you say I failed? I’m admitting I’m drunk”

drunk driving 1Robert Valdez Garcia, 46 of Bristol Wisconsin has been charged with OWI (4th w/in 5 yrs) and Operating While Revoked (Rev due to alc/contr subst/refusal). He was given a $2,000 cash bond after making his initial appearance in Racine Circuit Court on Thursday.

According to the criminal complaint, on June 2, 2016, Racine County Deputies responded to an accident at STH 75 and Church Road in Dover for an accident. Upon arrival the Deputy was approached by the defendant who appeared unsteady walking, the Deputy noted a strong smell of intoxicants coming from the defendant?and his speech was slurred. Without prompting the defendant allegedly told the Deputy, he knew he screwed up and would be going to jail. The Deputy noted that the defendant had bloodshot, glassy eyes.

The complaint states that the defendant gave his account of what transpired that he was driving home from a bar and ?when asked by the Deputy how much he had to drink, he indicated he would not answer. The defendant stated that another car pulled out in front of him and he couldn’t stop in time and hit it. The driver of the other vehicle also appeared intoxicated, they were both transported to the Patrol Station for Field Sobriety Testing.

Once at the Patrol Station the defendant made statements to Deputies when asked to perform the test such as “I’m drunk and I failed”, “I failed”. When Deputies asked if he wanted to perform the test again he allegedly asked Deputies “Can’t you just say I failed?”, “I’m admitting I’m drunk”.

The defendant failed one of the FST and said if he failed two more times he wouldn’t complete it. The defendant was transported to Wheaten Franciscan All Saints for a legal blood draw and at the time of charging the results were not known.
