Racine man charged with 7th OWI-PBT results show he was 4 times the legal limit

guerraGabriel O Guerra, 57 of Racine has been charged with 7th OWI and Operating While Revoked (Rev due to alc/contr subst/refusal). He was given a $7,500 cash bond after appearing in Racine Circuit Court Monday afternoon.

According to the criminal complaint on August 28,2015 Racine Police were dispatched to calls for a vehicle that was all over the roadway according to witnesses. Dispatched advised that the callers stated that the vehicle was driving all over the road and at times driving on the wrong side of the road. Witnesses also stated that they saw the defendant was also drinking what appeared to have been from an bottle containing alcohol. Racine Police caught up with the suspect vehicle and observed it had a flat front passenger tire. Officers then initiated a traffic stop with their lights and sirens, while the defendant was trying to pull over he crashed into another vehicle on Island Ave.

As the officer was approaching the vehicle, the defendant allegedly began trying to back up towards the officer. Officers yelled for him to stop and asked him to exit the vehicle. Officers observed the defendant was extremely intoxicated and could not focus. Officers asked the defendant is he had been drinking and he replied “yes”. Officers also noted there was an open bottle of UV Vodka in the vehicle. Additional officers spoke with witnesses who stated that he had hit curbs, crossed the center line and drove on the wrong side of the street. The defendant was place into custody and was transported to Wheaten Franciscan/All Saints after agreeing to a medical blood draw.

According to the criminal complaint the defendant had to be medically admitted due to his level of intoxication and blew a PBT of .35 more than 2 hours after his blood draw.
